1. About these terms

These Terms and Conditions are an agreement between you and Bony Levy ("we", "us", "our"). They apply to your use of BonyLevy.com and to every order you place with us, however you place it: on our website, by email, or through a third-party shopping service or assistant.

By using our site or placing an order, you agree to these terms, our Shipping & Returns policy and our Privacy Policy. If you sign up for text messages, our Mobile Terms also apply. If you do not agree, please do not use the site.

2. Your account

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. If you create an account, please give accurate information, keep your password private and let us know right away if you think someone else has used your account. You are responsible for activity under your account.

3. Our jewelry

We describe and photograph our jewelry as accurately as we can. Because many pieces are handcrafted, and because screens display color differently, the piece you receive may vary slightly from the photos in color, size or finish. Weights and measurements are approximate.

• Our diamonds are natural. We do not use lab-created stones in any of our creations.
• Gold is stated by karat (for example, 14K or 18K) in each product description. Some pieces are hollowed to give the look without the price and weight, and the description says so.
• Gemstones are natural materials and each one is unique in color and inclusions.

4. Pricing and availability

All prices are in US dollars. Prices, products and promotions can change at any time without notice. Our stock levels change daily, so a product shown on the site may not always be available.

Despite our care, a product may occasionally be listed with the wrong price or description. If that happens, we may cancel the order, or contact you to ask whether you would like to continue at the correct price. If you have already been charged for a cancelled order, we will refund you in full.

5. Orders and payment

Your order is an offer to buy. We accept it when we ship it to you. The confirmation email you receive after checkout means we have received your order, not that we have accepted it.

We may refuse or cancel any order, or limit quantities, for example if a product is unavailable, if we cannot verify your payment or address, or if we suspect fraud. Orders may be reviewed before they ship. If we cancel an order after you have paid, we will refund you in full.

You agree to pay the full price of your order, plus shipping and any applicable sales tax shown at checkout. Payments are handled by our payment processors; we do not store full card numbers.

6. Shipping

We ship within the United States only. Orders over $250 ship free by ground shipping, and UPS 2 Day and UPS Overnight are available for an additional fee at checkout. Delivery times are estimates. All packages require a signature on delivery.

Please inspect your package before signing for it. If it arrives damaged or something is missing, contact us within 48 hours with photos of the box, the packaging and the product. Full details are in our Shipping & Returns policy.

7. Returns

We accept returns within 30 days of the delivery date. Items must be unworn, unaltered and in their original packaging, and every return must be approved by us before you ship it. To start a return, email customercare@bonylevy.com with your name, address, order number and the reason for the return. A prepaid return label is included in your package, so returns ship back to us free of charge. Exchanges are accepted within 30 days of delivery, under the same conditions as returns.

Returned items are inspected when we receive them. If an item is not in its original condition or has been altered, we will send it back to you and the sale will be final. Accepted returns are credited within 7 to 10 business days after we receive the item. eGift Cards cannot be returned.

8. Custom orders

Custom pieces requested through our Custom Order page are made to your specifications. We will confirm the design, price, timeline and terms, including whether the finished piece can be returned or exchanged, in writing before production begins. Those written terms apply to your custom order in addition to these terms.

9. Care and repairs

Repairs must be approved by us before you send an item. Once we receive it, our jewelers will evaluate it, which may take up to 2 weeks, and contact you about any service fees and the time needed. We consider how long you have owned the piece and the condition it arrives in. See our Care and Repair page for details and care tips.

10. eGift Cards

Bony Levy eGift Cards are available in any amount and are delivered to the recipient by email. eGift Cards are nonrefundable, cannot be exchanged for cash except where the law requires it, and do not expire. Please treat an eGift Card code like cash: we are not responsible for a lost or stolen code.

11. Promotions and discount codes

Discount codes and promotions are subject to the terms stated with each offer. Unless an offer says otherwise, codes are limited to one per order, cannot be combined with other offers, cannot be applied to eGift Cards or to past orders, and have no cash value. Our 20% new-subscriber offer is valid on the first order only. We may end or change a promotion at any time, and we may cancel orders that use a code fraudulently or in breach of its terms.

12. Shopping assistants and third-party services

You may be able to find and buy our products through third-party services, such as AI shopping assistants and search platforms. When you place an order with us through one of these services, these terms apply to that order, and the service's own terms apply to your use of that service. Prices, availability and policies on our site are the ones that apply. We are not responsible for errors or information shown by a third-party service, and we will not accept an order based on a price or description that does not match our site.

13. Our content

Everything on our site, including our designs, photos, videos, text, logos and the Bony Levy name, belongs to us or our licensors and is protected by copyright and trademark law. You may view and share our pages for personal, non-commercial use. You may not copy, reproduce, sell or use our content for any other purpose without our written permission.

14. Using our site

Please do not use our site to break the law, place false or fraudulent orders, interfere with the site or its security, collect other people's information, or copy large parts of our catalog using automated tools without our permission. We may suspend or close accounts that do.

Our site may link to other websites. We do not control them and are not responsible for their content or practices.

15. Disclaimers and limitation of liability

To the fullest extent permitted by law, our site and its content are provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise that the site will always be available or free of errors.

To the fullest extent permitted by law, Bony Levy will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or any product, and our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some states do not allow certain warranty exclusions or limits on liability, so some of the above may not apply to you. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

16. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising from these terms or your use of our site will be handled in the state or federal courts located in Los Angeles County, California, unless the law requires otherwise. Before filing a claim, please contact us so we can try to resolve the issue informally.

17. Changes to these terms

We may update these terms from time to time. The effective date at the top of this page shows when they were last changed. The terms in effect when you place an order apply to that order. If any part of these terms is found unenforceable, the rest stays in effect.
